Question: Footnotes and Copyright Protected Documents

I have a two-part question.

First, if the author is using information from a copyright protected document, does he or she still have to get permission from the publisher even if he or she gives proper attribution through endnotes or footnotes?

Secondly, if information is readily available from a number of sources, is it necessary to even use a footnote? As an extreme example, if I wrote "Abraham Lincoln was assassinated at Ford's Theater in Washington, D.C.", I would not need an endnote, would I?
